The 2025 Legislative Change
For the first time since 2018, New Zealand has opened a clear and structured pathway for overseas investors to acquire residential property. Under amendments to the Overseas Investment Act passed in December 2025, holders of the Active Investor Plus visa — as well as Investor 1 and Investor 2 visa holders — may now purchase or build a home in New Zealand above NZ$5 million, without the requirement to reside here permanently.
The property may be used as a primary residence, a holiday home, or to operate a business subject to local planning rules. This is a significant and deliberately targeted change — one that does not reopen the broader housing market, but creates an explicit carve-out for ultra-high-net-worth investors who have already demonstrated commitment to New Zealand.
Consent is still required from the Overseas Investment Office. The process has been streamlined — applications are generally decided within five working days, with consent fees of NZ$2,040 for existing homes and NZ$3,500 for new builds.

Who Qualifies
Active Investor Plus Visa Holders
New Zealand's premier investor pathway, requiring a minimum NZ$5 million direct investment. Holders may now acquire residential property above NZ$5 million without the requirement to be physically present in New Zealand.
Australian & Singaporean Citizens
Citizens of Australia and Singapore may purchase New Zealand residential property without restriction, by virtue of free trade agreements between their governments and New Zealand. Permanent residents of both countries who are ordinarily resident in New Zealand share the same entitlement.
Residence Class Visa Holders
Those holding a New Zealand residence class visa but not yet ordinarily resident may purchase one home to live in, subject to consent from Toitū Te Whenua Land Information New Zealand. Pre-approval lasting up to 12 months is available.
The Active Investor Plus Visa
Designed to attract experienced, high-calibre investors to New Zealand, the Active Investor Plus visa is the country's most prestigious investor pathway. It requires a minimum NZ$5 million direct investment into New Zealand businesses or managed funds, with indirect investment options available at a weighted rate.
As of late 2025, Immigration New Zealand had received over 490 applications under the current settings, representing over NZ$770 million in committed investment. American nationals represent the largest applicant group, followed by Chinese citizens — reflecting the global appetite for New Zealand residency and the lifestyle it affords.

Overseas Investment Office consent is required prior to any unconditional purchase commitment, and sale and purchase agreements should reflect immigration status conditions — engaging qualified New Zealand legal counsel is essential. Structures such as trusts and companies do not bypass overseas investment rules: if 25% or more of effective control is held by an overseas person, the same restrictions apply. There are significant anti-avoidance provisions under the Overseas Investment Act, and penalties for circumventing the rules are substantial. Tax residency implications should be considered independently with a qualified New Zealand tax advisor.
